These terms are a simple agreement between you and INCLUDE LLC about using TismTimers. We've written them in plain language because legal documents shouldn't require a law degree to understand.
By downloading or using TismTimers, you agree to these terms. If you don't agree, that's okay — but please don't use the app.
TismTimers is available on iOS and Android. You must be at least 13 years old to use it.
TismTimers is a timer and routine management app designed for neurodivergent users. You can create one-time and recurring timers, track completions, and earn collectible card rewards. All of your timer data is stored locally on your device.
TismTimers offers a subscription with the following pricing:
Monthly: $3.00/month
Annual: $20.00/year
Free trial: 7 days (for new subscribers)
Your subscription is billed through the Apple App Store or Google Play Store, depending on your device. After your free trial ends, you will be charged automatically unless you cancel before the trial period is over.
Subscriptions renew automatically at the end of each billing period. You can cancel anytime through your Apple App Store or Google Play Store account settings. Cancellation takes effect at the end of your current billing period — you'll still have access until then.
Refunds are handled by Apple or Google according to their standard refund policies. If you need a refund, you'll need to request one through the Apple App Store or Google Play Store directly.
TismTimers includes an optional feature where you can submit a photo of your pet for possible inclusion in a future app update. Here's how that works:
What you're sharing: When you submit, you provide your name, your pet's name, pet type/breed, a fun fact about your pet, and a photo. This information is stored in our cloud database (Supabase).
What you're granting us: By submitting a pet photo, you give INCLUDE LLC permission to use the photo, pet name, and related details within the TismTimers app. This permission is non-exclusive (you can still use your photo however you like) and royalty-free (we won't pay a fee for using it in the app).
No guarantee of inclusion: We may or may not include your submission in a future update. INCLUDE LLC reserves the right to decline any submission for any reason.
Your responsibility: By submitting a photo, you confirm that it's your photo (or you have permission to share it) and that it's a photo of a real pet. Please don't submit photos you don't have the right to share.
Requesting removal: If you change your mind, you can email us at tismtimers@gmail.com to request deletion of your submission. We'll remove it within 30 days. If the photo has already been included in an app update, we will remove it in a future update as soon as reasonably possible.
Your timer and routine data lives on your device. We can't access it, back it up, or recover it. If you delete the app or switch devices, that data may be lost unless your device backs it up automatically (for example, through iCloud or Google's backup services).

We ask that you use TismTimers in a way that's respectful and lawful. Specifically, please don't:
Reverse-engineer, copy, or redistribute the app or its content. Submit pet photos that are offensive, inappropriate, or that you don't have the right to share. Attempt to interfere with the app's functionality or security. Use the app for any illegal purpose.
We reserve the right to remove submissions or restrict access to the app if these terms are violated.
TismTimers — including its name, design, code, collectible card artwork, and all other content — is owned by INCLUDE LLC. Your subscription gives you a personal, non-transferable license to use the app. It doesn't transfer ownership of any part of the app to you.
You may not reproduce, distribute, sell, license, or otherwise commercially exploit the TismTimers name, the TismToad character, or any representation of their image or likeness without the express written permission of INCLUDE LLC. This includes merchandise, derivative works, AI-generated likenesses, and any other use intended to profit from the name or character.
Personal, non-commercial use — such as sharing a screenshot or talking about the app — is fine. What's not allowed is using our name or character to make money without our permission.
The exception is your own data: your timers, routines, and any photos you submit remain yours.
TismTimers is a productivity and routine management tool. It is not a medical device, therapy, or treatment. It does not provide medical or clinical advice. If you have questions about managing ADHD, autism, or any other condition, please consult a qualified professional.
We provide TismTimers "as is." We do our best to keep it running smoothly, but we can't guarantee it will be error-free or available 100% of the time. INCLUDE LLC is not liable for any lost data, missed timers, or other issues that arise from using the app.
To the maximum extent permitted by law, INCLUDE LLC's total liability to you for any claim related to the app is limited to the amount you've paid us in the 12 months before the claim arose.
We may update these terms from time to time. If we make meaningful changes, we'll update the effective date at the top and may notify you through the app. Continued use of TismTimers after changes take effect means you accept the updated terms.
These terms are governed by the laws of the state in which INCLUDE LLC is organized, without regard to conflict-of-law rules.
